The following document contains the legal notice and terms of use for the Website (the “Legal Notice and Terms of Use” or the “Legal Notice”) made available to users by ABALEAR.

Accessing and using the Website implies that the user (the “User” or “Users,” as applicable) fully accepts and agrees to comply with the terms and conditions outlined in this Legal Notice and Terms of Use. Therefore, the User must carefully read this Legal Notice each time they intend to use the Website, as it and its terms of use may be modified.

Terms of Use

The User agrees not to use the Website for fraudulent purposes, nor to engage in any conduct that could damage the image, interests, and rights of ABALEAR or third parties. Additionally, the User agrees not to take any actions that could damage, disable, or overload the Website or interfere with its normal use and operation. Users are informed that in case of non-compliance with this Legal Notice, Privacy Policy, or any other terms or conditions on the Website, ABALEAR reserves the right to limit, suspend, or terminate their access to the Website, taking any technical measures necessary for that purpose. ABALEAR may also exercise such measures if it reasonably suspects that the User is breaching any of the terms and conditions outlined in this Legal Notice.

Additionally, the User is informed that ABALEAR reserves the right to decide at any time whether to continue offering the information society services provided through the Website.

Information Contained on the Website

The Website’s purpose is to present information about properties owned by third parties marketed by ABALEAR or other third parties or about marketing channels. This information should not be considered as an offer to sell or lease or as a recommendation for any transaction.

Property information on the Website is (i) merely descriptive and not contractual; (ii) selective and subject to updates, expansions, revisions, and modifications; and (iii) not intended to include all information users may need for decisions on purchasing properties displayed. Interested parties may contact the respective sales channels directly to obtain complete and updated details, including ownership status, charges, and legal-registrar information, which should be verified at the appropriate Property Registry and local Public Administrations. Furthermore, graphical information may not always be up-to-date, so any purchase decisions require prior site visits and verification by the interested party.

No legal transaction regarding the purchase of properties is concluded through the Website. Contracts or purchase agreements will only be formalized through the procedures specified for each property.

User Registration and Password

By registering on the Website, a user will receive a login ID as a “Registered User” allowing access to additional functionalities. Passwords must not contain offensive, injurious, or unauthorized terms. Users are responsible for safeguarding their passwords and liable for all account activity, and must notify ABALEAR of any loss or theft.

Intellectual and Industrial Property

Intellectual and industrial property rights on the Website, including content arrangement, underlying databases, graphic design, user interface, computer programs, and other elements (texts, graphics, photographs, videos, etc.) (the “Content”), belong to ABALEAR or its licensors. Any use of the Website by the User does not imply a transfer of intellectual or industrial property rights.

The User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, or reusing the Website, its Content, and/or any of ABALEAR’s distinctive signs, unless legally permitted or with prior authorization from ABALEAR.

ABALEAR grants Users who accept the terms a non-exclusive authorization to use the Website worldwide, valid for the maximum period of intellectual and industrial property rights under applicable law (unless access is suspended for justified reasons), so the User may use the Website according to this document.

ABALEAR reserves the right to redesign and vary the Website’s presentation and configuration unilaterally and without prior notice.

Link Policy (“Links”)

Establishing links to the Website is prohibited without prior authorization. If authorized, links must meet the following conditions:

  • Link only to the main homepage.
  • Must not consist of frames displaying the Website alongside other websites or display false information about the Website and/or ABALEAR.
  • Authorization does not imply sponsorship or responsibility for content or services provided by the linking site.

If a link’s terms are breached, ABALEAR may remove the link without prior notice.

Linked Sites

To provide additional information, various technical linking tools may be included on the Website, allowing Users to access other sites (“Linked Sites”). ABALEAR is not responsible for services or content on Linked Sites, except when there is knowledge of illegality and links are not removed with due diligence.

ABALEAR does not endorse, promote, or identify with Linked Sites, nor is it responsible for Linked Sites’ content or policies. Users are solely responsible for checking and accepting these terms whenever accessing Linked Sites.

Communication of Unlawful or Inappropriate Activities

If the User or any internet user knows of unlawful or inappropriate content on the Website, they may notify ABALEAR, providing the following:

  1. Personal data (name, address, telephone, email).
  2. Description of the facts and exact location.
  3. For third-party rights violations, provide data of the rights holder if different from the notifier, including documents proving ownership.

ABALEAR may remove or suspend content that, although not illegal, breaches this Legal Notice. ABALEAR is not obliged to remove content based solely on notification and reserves the right to evaluate each case’s circumstances.

Responsibility of ABALEAR

Users should be aware that open network communications are exposed to numerous threats. Users must take all necessary technical measures, including updated malware detection systems and security patches, to mitigate these threats. ABALEAR is not liable for damages due to system vulnerabilities or open network risks, as the User is solely responsible for their security measures.

ABALEAR will only be liable for damages caused directly by intentional misconduct or gross negligence and where there is no negligence by the User.
